April 26, 2025ICE circulated an internal notice on the Student and Exchange Visitor Information System, titled, “Policy Regarding Termination of Records.” The notice claimed that the Student Exchange Visitor Program (SEVP) has an "inherent . . . authority" to terminate SEVIS records as part of its mission to maintain and update records relating to nonimmigrant students and exchange visitors. The notice asserts that while a terminated record in SEVIS could indicate that the nonimmigrant no longer maintains F or M status, termination may be for "several normal, administrative reasons" that "do[] not always result in an adverse impact on the student." Reasons for termination could include:
- Exceeded Unemployment Time
- Failure to Comply with I-515A
- Failure to Repay the I-901 Fee Chargeback
- Failure to Report While on OPT
- No Show
- School Withdrawn
- Violation of Change of Status Requirements
- Change of Status Approved
- Evidence of a Failure to Comply with the Terms of Nonimmigrant Status Exists
- Department of State (DOS) Visa Revocation
Among the above listed reasons, the three significant Trump 2.0 changes include the exceeded unemployment time; change of status or gap in status; and DOS visa revocation, “effective immediately.” This final change, namely that ICE intends to terminate students’ SEVIS records whenever the DOS revokes an international student’s visa, means that SEVIS records may appear as terminated even before a student undergoes removal proceedings and has his or her status terminated.
