Reported: Immigration agents demand tenant information from landlords, stirring questions and confusion

The Associated Press reports that immigration authorities are pressuring landlords to provide detailed tenant records, including leases, rental applications, and IDs, as part of a broader deportation push. "Eric Teusink, an Atlanta-area real estate attorney, said several clients recently received subpoenas asking for entire files on tenants. The two-page 'information enforcement subpoena' . . . also asks for information on other people who lived with the tenant." At least one subpoena was signed by a USCIS anti-fraud officer, not a judge.

DHS defended ICE's use of subpoenas against landlords, without confirming if they are currently being used, and warned of legal consequences for noncompliance. However, the AP notes that "if landlords comply, they might risk violating the Fair Housing Act, which prohibits discrimination on the basis of race, color or national origin." One real estate attorney, in consultation with immigration attorneys, "concluded that compliance is optional."
