September 23, 2025EOIR Acting Deputy Director Roman Chaban issues Policy Memorandum (PM) 25-37 to "[c]onsolidate and update EOIR policies regarding the handling of classified information in EOIR adjudicatory proceedings" and adds OCAHO to the procedures and rules that already apply to the Immigration Courts and the BIA.
To effect that consolidation, this PM rescinds, cancels, and supersedes the Office of the Chief Immigration Judge (OCIJ) Operating Policies and Procedures Memoranda (OPPM) 24-01, Classified Information in Immigration Court Proceedings, and BIA OPPM 24-01, Classified Information at the Board of Immigration Appeals. The PM incorporates most of the information contained in those two memos.
The PM also makes it clear that DHS, not the IJ or the BIA, controls when evidence can be released to the respondent.
