CBP issues directive governing emergency driving and vehicular pursuits

    Customs and Border Protection (CBP) issued a new directive governing emergency driving and vehicular pursuits, replacing a 2023 directive. The prior directive established a "reasonableness" standard requiring officers to consider a number of potential risks to the public, other officers, and vehicle passengers before engaging in a vehicular chase. The new directive does not mention this reasonableness standard or the associated risk factors, instead instructing agents to "[s]elf-terminate any [vehicular pursuits] if the law enforcement benefit of continuing such action no longer outweighs the risk to the public." The directive also explains reporting requirements for agents who do such pursuits.
