CBP issues memorandum "Ending Catch and Release"

    Senior Official Performing the Duties of the Commissioner of CBP, Pete Flores, orders CBP personnel to "take every reasonable action to ensure that aliens that enter the United States without proper immigration documents are detained until removed." Only the Executive Assistant Commissioner (EAC) of the Office of Field Operations (OFO) and the Chief of the Border Patrol (USBP), headquarters personnel approved in writing by the EAC or Chief, and the Directors of Field Operations and Chief Patrol Agents may grant parole under INA section 212(d)(5)(A). Each parole grant will be reported to the Acting Commissioner and Chief of Staff and will include an individualized justification for the parole's urgent humanitarian reasons or significant public benefit.

      Bloomberg reports that CBP is holding migrant families with children at a tent facility in Otay Mesa, CA, for longer than agency guidelines permit. "Some families have been held for 10 days or more at [the] soft-sided facility," despite CBP guidelines stating "that people should not be held in such spaces longer than 72 hours" and noting "special care should be taken for families and unaccompanied children."
