CBP issues final rule to collect biometric information from noncitizens at ports of entry

    CBP issued a final rule amending regulations to provide that DHS may require all noncitizens to be photographed for "facial comparison" purposes when entering or exiting the United States, including noncitizens previously exempt (such as those under 14 or over 79). DHS may also require non-exempt noncitizens to provide other biometric information, like "fingerprints, photographs, iris, DNA, and voice print." The rule also removes references to pilot programs as well as port limitations; biometrics can be collected from noncitizens departing from "airports, land ports, seaports, or any other authorized point of departure."

    U.S. citizens may be photographed at entry and exit under the final rule if they "voluntarily participate in biometric collection," but may "opt out of being photographed for the purpose of identity verification using biometric facial comparison."

    The final rule is effective December 26, 2025. DHS invited comments until November 26, 2025 on the "specific collection process" and the costs and benefits of expanding biometric collection to new forms of transportation.
