May 5, 2025CBP rescinded and replaced its 2024 directive, CBP Responses to Certain Crimes, Incidents, & Imminent Life-Threatening Emergencies & Federal, State, Local Tribal & Territorial Support Requests. The new guidance instructs that: "Requests for assistance that fall outside the scope of routine duties, or that occur beyond an immediate operational area, require Headquarters awareness and concurrence. In situations involving an imminent threat to life, immediate response is appropriate; however, notification to Headquarters leadership must occur concurrently. In all other circumstances, notification and coordination should precede any action."
Prior guidance authorized and required on-duty CBP law-enforcement personnel to arrest individuals "in their presence" who commit federal criminal offenses, authorizing them to take discretionary action in response to a state or federal "Crime of Violence," assist Federal, State, Local, Tribal, or Territorial (FSLTT) law-enforcement officers with "emergency assistance or aid" where requested when doing so in "an objectively reasonable manner," and to respond to an "Imminent Life-Threatening Emergency" where they "know or have an articulable reason to believe they can respond before any other law enforcement officer." The guidance permitted, but did not require, off-duty officers to do the same.
