June 25, 2025CNN reports that U.S. Citizenship and Immigration Services (USCIS) "is planning to dismiss asylum claims for potentially hundreds of thousands of migrants in the United States and then make them immediately deportable" by placing them in expedited removal proceedings. Department of Homeland Security Kristi Noem has delegated authority to USCIS to place individuals in expedited removal proceedings. Typically, if USCIS determined an individual was ineligible for asylum, USCIS would pass that individual's application to ICE for further proceedings.
The combination of dismissing pending asylum claims and delegating expedited removal authority to USCIS will allow immigration authorities to remove individuals without any hearing before an immigration judge. CNN reports that because USCIS is typically considered the agency charged with providing immigration benefits rather than conducting enforcement, "[e]xperts and advocates warn that placing USCIS at the center of the president’s deportation campaign is likely to have a chilling effect for those trying to obtain relief and remain in the United States."
