DHS delegates authority to Director of USCIS to order expedited removal and carry out other immigration enforcement powers

    DHS issues Delegation No. 15006, vesting authority in the Director of USCIS to order expedited removals pursuant to 8 U.S.C 1225 and "to take additional actions to enforce civil and criminal violations of the immigration laws.” This authority also includes the power to issue and execute detainers and warrants of arrest or removal, detain immigrants, release immigrants on bond, and investigate alleged civil and criminal violations.

    The delegation supersedes and replaces paragraph 3 of section III, "Reservations," of Delegation No. 0150.1 (Issue Date 6/5/2003), which read: " Unless specifically provided therein, nothing in this delegation authorizes the BCIS [Bureau of Citizenship and Immigration Services] to enforce immigration laws by inspection of aliens or vehicles, issuance or execution of warrants, detention or release of aliens on bond, removal of aliens from the United States, issuance of stays of removal, reinstatement of removal orders, or any other enforcement authority exclusively delegated to the Commissioner of CBP or the Assistant Secretary for ICE."

    2025.09.05 DHS Final Rule - Codification of Certain USCIS Law Enforcement Authorities

    DHS issued a final rule to codify into regulation certain provisions in Delegation No. 15006. The provisions include those authorizing the USCIS Director to designate other individuals as having the ability to investigate criminal violations of immigration law, issue and execute search and arrest warrants, and carry firearms. DHS states that the rule “will allow the Director of USCIS to more thoroughly fulfill USCIS’ national security, public safety, and fraud missions for cases within its jurisdiction.”us
