January 24, 2025Acting Secretary of Homeland Security Benjamine Huffman finds "'that there exist circumstances involving the administration of the immigration laws of the U.S. that endanger the lives, property, safety, and welfare of the residents' of all 50 States," and that "an actual or imminent mass influx of aliens is arriving at the southern border of the United States and presents urgent circumstances requiring an immediate federal response." Pursuant to INA § 103(a)(10), 8 USC § 1103(a)(10), and implementing regulations, DHS requests assistance of State and local governments in all 50 States.
The finding is effective immediately and expires in 60 days unless extended.

2025.01.31 - CBP and Texas National Guard MOU
Customs and Border Protection (CBP) entered into a Memorandum of Understanding (MOU) with the Texas National Guard, granting the Guard authority to act as immigration officers in a State Active Duty status under Title 8.
Under this agreement, Texas officials are authorized, under the supervision and direction of a CBP official, to perform specified immigration functions that include investigating immigration violations, arresting individuals for immigration violations, and transporting noncitizens for the purposes of detention and removal.
DHS waived all immigration training requirements for Guard personnel exercising these authorities. CBP retains the authority to supervise and direct Guard activities.
Texas will bear all MOU costs but will keep records in case CBP offers reimbursement.

2025.01.31 United States v. State of Texas, 1:24-cv-00008 (W.D. Tex.) - Order Clarifying/Modifying Preliminary Injunction Issued on February 29, 2024
On January 31, 2025, the U.S. District Court for the Western District of Texas modified a February 2024 preliminary injunction that enjoined the State of Texas and related parties from enforcing parts of Texas Senate Bill 4. The order modified the injunction to clarify that, in light of EO 14165 and EO 14159, Texas state and local law enforcement are permitted to cooperate with federal authorities regarding the "apprehension, arrest, and detention of undocumented persons." The rest of the injunction, including prohibiting Texas judges and law enforcement from "engag[ing] in the actual deportation of undocumented persons from the United States," remains in effect.

2025.02.10 Hundreds of Texas National Guard troops headed to Laredo to help Border Patrol - Border Report
Border Report reports that Laredo Sector Chief Border Patrol Agent Jesse Muñoz announced that over 300 Texas National Guard soldiers will be sent to the border to strengthen border security. Under a new agreement with CBP, these troops will be allowed to perform immigration officer duties. They will have the authority to question immigration status and make arrests under Title 8 while supervised by CBP officials.
