Former Nebraska State Senator DiAnna Schimek and thirteen McCook residents sued Governor Jim Pillen and the Nebraska Department of Correctional Services director in state court. The complaint alleges that state officials voluntarily offered the Work Ethic Camp in McCook, an "incarceration work camp" for nonviolent offenders, to the federal government to repurpose the facility into a 300-bed, high-security ICE detention center. According to the complaint, officials have already begun the process of contracting for construction and transferring WEC inmates out of the facility. Plaintiffs argue that the repurposing of the facility without legislative authority violates the Nebraska Constitution's separation of powers doctrine as well as state law. They seek a temporary and permanent injunction to stop the conversion and a judgment declaring the actions unlawful.
Reporting on the suit, the New York Times explained that the WEC is the state's only prison focused exclusively on rehabilitating nonviolent offenders nearing release. Local officials say they received no advance notice and have no expectations that any revenue from the ICE agreement will be shared with the city
