DHS terminates TPS for Ethiopia

    USCIS issued a notice in the Federal Register announcing the termination of TPS for Ethiopia. TPS for Ethiopia has been based on both "ongoing armed conflict" and "extraordinary and temporary conditions." The Notice explains that DHS has determined that the country is no longer experiencing "an ongoing armed conflict that poses a serious threat to returning Ethiopian nationals" and that the "extraordinary and temporary conditions" no longer merit TPS. Additionally and in connection with the extraordinary and temporary conditions grounds for TPS, DHS determined that it was no longer in the "national interest" to permit Ethiopian nationals to remain in the United States under TPS because of visa overstay rates and concerns about security and benefits fraud.

    2026.01.22 Complaint - African Communities Together v. Noem

    African Communities Together (ACT) and three Ethiopian Temporary Protected Status (TPS) holders filed a class action suit challenging the Trump administration's termination of TPS for Ethiopia. The plaintiffs argue that the termination was procedurally defective in violation of the Administrative Procedure Act (APA) and intentionally discriminatory on the basis of race and/or national origin in violation of the Fifth Amendment guarantee of equal protection under the law. The suit seeks declaratory and injunctive relief and asks the court to postpone and ultimately vacate the termination of TPS for Ethiopia. African Communities Together v. Noem, 1:26-cv-10278 (D.     2026.01.30 Order - African Communities Together v. Noem

    District Judge Brian E. Murphy stayed the termination of Ethiopia’s TPS designation to “preserve the status quo in advance of the Court’s full consideration of the merits of [plaintiffs’ motion for administrative stay].” The court clarified that the legal consequences of being in TPS status and having a pending TPS application based on Ethiopia’s designation shall continue to apply.     2025.03.12 USCIS - Update on Termination TPS for Ethiopia

    USCIS issued an update following the stay in African Communities Together v. Noem, No. 1:25-cv-13939 (D. Mass.), on January 30, 2026. The update states that TPS Ethiopia beneficiaries will keep their status and employment authorization. Employment Authorization Documents (EADs) with category A12 or C19 remain valid and are extended.
