DOJ circulates notices in EOIR immigration courts urging self-deportation

  1. Original Date Announced

    May 5, 2025

A new Department of Justice (DOJ) flyer titled Message to Illegal Aliens: A Warning to Self-Deport” has surfaced in immigration-court communications and courthouses across the U.S., through DOJ's Executive Office of Immigration Review (EOIR). Available in English and Spanish, it outlines the supposed benefits of self-deportation—such as leaving “on your own terms,” keeping earned income, and receiving subsidized travel—while warning of consequences like daily fines up to $1,000, jail time, and “immediate deportation” by ICE. It promotes the CBP Home mobile app as a “safe” way to self-deport and offers a $1,000 stipend as an incentive. The flyer makes no distinction between immigrants with final removal orders and those potentially eligible for relief such as asylum or cancellation of removal, and omits any mention of the right to appeal a removal order.

  • 2025.05.07 AILA - Practice Alert: EOIR Is Circulating Misleading Legal Advisories to Respondents

AILA issues a practice alert about flyers posted in EOIR courts nationwide titled “Message to Illegal Aliens: A Warning to Self-Deport.” According to AILA, the flyers list several confusing and misleading statements about “benefits” and “consequences” of self-deportation. AILA members report that these flyers were posted in EOIR spaces, including lobbies and courtrooms, and that EOIR is sending flyers to immigrants with scheduling orders, orders granting relief, and Board of Immigration Appeals (BIA) packages, and in some cases, uploading them into electronic records of proceedings.
