Original Date Announced
June 12, 2025The Department of Justice (DOJ) filed suit against the state of New York to challenge the Protect Our Courts Act, a 2020 state law that prohibits federal officers from conducting civil arrests in or around courthouses without a warrant signed by a judge, as well as its accompanying policies. The complaint alleges preemption by federal immigration law because the state rules “pose intolerable obstacles to federal immigration enforcement and directly regulate and discriminate against the Federal Government” in violation of the Supremacy Clause of the Constitution.
