EOIR issues new guidance on cases subject to the cancellation/suspension cap

    EOIR issues Operating Policies and Procedures Memorandum (OPPM) 17-04 on the procedures for cases involving applications for cancellation of removal or suspension of deportation that are subject to the annual cap. This OPPM supersedes predecessor OPPM 12-01. The OPPM lists the circumstances in which an immigration judge may render a final decision on the application after the cap has been reached. It also provides instructions on what the judge should do when a decision must be held in abeyance because of the cap.
