April 11, 2025The Department of Justice announced an interim final rule, scheduled to be published on April 14, 2025, reducing the size of the BIA to 15 members. The size of the BIA was last addressed by a rule promulgated in April 2024, which provided for 28 permanent Board members to address the Board's backlog. The new interim final rule states that "increasing the Board’s size has not brought about the hoped-for increases in productivity," and has instead "added structural inefficiencies."
The reduction is aimed at addressing "significant institutional costs, including effects on the cohesiveness of the Board’s decisionmaking process and the collegiality among Board members, a loss of uniformity in its nonprecedent decisions, increased difficulty providing effective leadership, as well as an administrative and supervisory strain on the Board’s limited legal staff."
Public comments on the rule must be received within 30 days of the publication date.
