October 18, 2018EOIR plans to finalize proposed regulations to amend jurisdiction and venue rules in response to the increased number of hearings being conducted through telephone and video teleconferencing (VTC). Under the proposed rule, venue lies where the designated hearing is scheduled, regardless of the location of the IJ or the administrative control court. It would also clarify that, upon the filing of the Notice to Appear (NTA), jurisdiction vests with the Office of the Chief Immigration Judge (OCIJ) and not the specific court where the NTA was filed.
