DOJ proposes changes to Form EOIR-33 (Change of Address/Contact Information)

    EOIR issued a notice and request for comments on proposed revisions to Form EOIR-33, "Change of Address/Contact Information" which impacts two versions of the Form EOIR-33, one tailored for submission to the Immigration Courts (EOIR-33/IC) and one tailored for submission to the Board (EOIR-33/BIA). This form is used by noncitizens to inform the immigration court and the Board of a new address as required per 8 CFR section 1003.15(d)(2). EOIR had requested emergency review from the OMB, and received approval for emergency review on March 2, 2026.

    The proposed change would remove two address form fields marked: “'in care of' other person (if any).” The current version of the form allows noncitizens to use these fields to designate a third party to receive mail from the agency on their behalf. EOIR states that the designation "assumes, without verification, that the third party is trustworthy" and "presents potentially nefarious third parties" with opportunities to interfere with immigration court proceedings and gain private information. EOIR also states that the field "allows certain aliens to obscure their true address from immigration officials."

    Comments are accepted until May 4, 2026.
