EO 14188 § 3(e) directs agencies to report on recommendations for higher education institutions to monitor and report noncitizen students and staff for possible removal

    President Trump issues Executive Order (EO) 14188, "Additional Measures to Combat Anti-Semitism," reaffirming and expanding EO 13899, "Combatting Anti-Semitism," from December 11, 2019.

    Of relevance, section 3(e) directs the Secretaries of the Department of State, Education, and Homeland Security to issue reports to the president within 60 days. Such reports must include "recommendations for familiarizing institutions of higher education with the grounds for inadmissibility under 8 U.S.C. 1182(a)(3)." This is so that institutions of higher education may monitor and report activities conducted by non-citizen students and staff relevant to those grounds and ensure that such reports lead, as appropriate and consistent with applicable law, to investigations and, if warranted, actions to remove such individuals.

      The White House issued a Fact Sheet to accompany EO 14188. The Fact Sheet outlines, among other things, the administration’s promise to "Deport Hamas Sympathizers and Revoke Student Visas." It states: "To all resident aliens who joined in the pro-jihadist protests, we put you on notice: Come 2025, we will find you, and we will deport you. I will also swiftly cancel the student visas of all Hamas sympathizers on college campuses, which have been infested with radicalism like never before."
