Original Date Announced
January 24, 2025President Trump issued an Executive Order (EO) "Enforcing The Hyde Amendment," stating that it is U.S. policy "to end the forced use of Federal taxpayer dollars to fund or promote elective abortion." EO § 2 rescinds two executive orders of the previous administration:
- Executive Order 14076 of July 8, 2022 (Protecting Access to Reproductive Healthcare Services)
- Executive Order 14079 of August 3, 2022 (Securing Access to Reproductive and Other Healthcare Services)
EO § 3 directs OMB's Director to promulgate guidance to the heads of executive departments and agencies related to EO implementation.
EO may restrict abortion coverage for immigrants who receive their healthcare in detention facilities and Office of Refugee Resettlement (ORR) shelters.

A settlement was reached in J.D. v. Azar (originally Garza v. Hargan) where the federal government agreed to adopt a new policy that it would not interfere with noncitizen children’s access to abortion and would put in place limits on disclosure of their pregnancy and abortion information.
