EOIR Acting Director Reinstates Trump Memo on Pro Bono Representation

    EOIR Acting Director issued PM 25-08 on pro bono representation, rescinding DM 22-01 and reinstating PM 21-08. The Acting Director criticizes DM 22-01's rescission of PM 21-08 because "no reason was given for the rescission, and none is readily apparent." It further explains that, "in light of current Executive Branch policies, retaining DM 22-01 is inappropriate."

    PM 21-08 updated guidance on pro bono legal services practices, including before the immigration courts and the BIA. PM 25-08 chastises the pro bono community for not representing cases before EOIR's Office of the Chief Administrative Hearing Officer (OCAHO) under 8 U.S.C. § 1324b - Unfair Immigration-Related Employment Practices. PM 25-08 directs that reinstated PM 21-08 "be read to place a special emphasis on facilitating more pro bono services and representation for complainants in such OCAHO cases.
