EOIR Acting Director issues guidance regarding deadlines and issuance of IJ decisions

    EOIR Acting Director Sirce Owen issued Policy Memorandum (PM) 25-39 to cancel and replace OPPM 93-1, prior guidance on the issuance of IJ decisions and orders.

    This PM requires all written (i.e., reserved) decisions to be issued within 10 business days from the final hearing date, if the respondent is detained, or within 60 calendar days from the final hearing date, if the respondent is not detained. Oral decisions must be delivered by the IJ in the presence of the respondent and DHS counsel at the end of the hearing, and decisions memorializing in absentia orders of removal must be rendered on the same date as the scheduled hearing for which the noncitizen did not appear.
