September 15, 2025EOIR Acting Director Sirce Owen issued Policy Memorandum (PM) 25-49 on bond redetermination requests that are pending when a detainee is transferred between facilities.
The PM directs that, when DHS has transferred a detainee to a facility in a different geographic area, any bond redetermination request that is pending will be “clerically transferred” to the immigration court of the new detention location. The originating immigration court may not treat the redetermination request as withdrawn, unless the detainee or the detainee's representative has requested that it be withdrawn.
This clerical transfer must take place within 48 hours of notification of the detainee’s transfer, and the receiving court must hold a custody redetermination hearing within the established timeframes, notwithstanding the transfer.
