January 31, 2025On January 31, 2025, the EOIR Acting Director issued PM 25-14 regarding the role of child advocates in immigration proceedings, reinstating PM 20-03 from the first Trump term. The new memo rescinded intervening memo, DM 23-03, because there was no express reason for it to rescind the Trump memo and, per the Acting Director, the prior guidance on the role of child advocates "grossly infringes on an Immigration Judge's decisional independence."
PM 20-03 provided guidance on Child Advocates for Unaccompanied Children (UCs) appointed by HHS. The memo states HHS does not have authority to appoint Child Advocates for all UACs and limits Child Advocates' capacity to assist UCs during removal proceedings.
