January 12, 2021The EOIR Director issues Policy Memo 21-14, asserting that no EOIR regulations issued in 2020 were intended "to conflict with, supersede, or abrogate" any federal court orders that were binding on EOIR on the date the regulations went into effect. This applies both to regulations in effect now or in the future. The memo goes on to say that, should judges perceive a conflict, they should comply with the federal court order.
