EOIR discourages IJs from granting continuances

    The Chief Immigration Judge issues Operations Policy and Procedures Memorandum (OPPM) 17-01, urging IJs to be more efficient with respect to continuances (lest "adjudicatory inefficiencies" exacerbate the case backlog) and reminding IJs of respondents' "strong incentive" to abuse continuances.

    The OPPM directs IJs to make the reasons for granting a continuance clear on the record, and it provides guidance specific to continuances to obtain counsel, continuances for attorney preparation, continuances of merits hearings, and continuances that are requested by DHS.
