EOIR Interim Rule: Expanding the Size of the Board of Immigration Appeals
In an interim rule, EOIR added two more Board Member positions to the BIA, raising the total from 21 to 23 judges. Combined with the 2018 expansion, the two rules result in six appellate judge positions being created and appointed by the Trump administration.

On April 2, 2024, the DOJ published a final rule expanding the Board of Immigration Appeals by adding five Board member positions. Given the expansion of the Board to 23 members in 2021, this Biden administration policy thereby expands the Board to 28 members.
