EOIR rescinds guidance on internet-based immigration hearings

    The EOIR Acting Director issued Policy Memorandum (PM) 25-25 rescinding and cancelling Director’s Memorandum (DM) 22-07. DM 22-07 provided guidance to immigration judges on internet-based video hearings and included language that, while it is the judge's decision whether a respondent or witness appears in person or remotely, the judge should accommodate the respondent’s or witness’ preference when appropriate and practicable.

    PM 25-25 states that DM 22-07 was “purposeless” and beyond the authority of the Director, as it “directed" judges to decide motions related to video hearings in a particular way. It also claims that DM 22-07 contradicted Trump-era PM 21-03 on the use of telephones and video teleconferencing to conduct hearings.
