HHS issues final rule making DACA recipients ineligible for ACA health coverage

    The Centers for Medicare & Medicaid Services (CMS), a division of HHS, issued a final rule changing the definition of "lawfully present" under the Affordable Care Act (ACA) to exclude DACA recipients. The new rule makes DACA recipients ineligible to access health coverage under the ACA. Under the Biden administration, HHS had expanded the definition of "lawfully present" to include DACA recipients, making them eligible to access health coverage under the ACA.

    The rule goes into effect on August 25, 2025.
