HUD issues proposed rule requiring immigration status verification of every resident in households receiving federal housing assistance

    The Department of Housing and Urban Development (HUD) issued a Notice of Proposed Rulemaking (NPRM) related to federal housing assistance programs that are governed by Section 214 of the Housing and Community Development Act (HCDA), such as public housing, Housing Choice Vouchers, and Section 8. The HCDA limits housing assistance eligibility to U.S. citizens and certain categories of noncitizens. The NPRM proposes two major changes.

    First, the proposed rule would revise HUD regulations implementing Section 214 to require that every member of a household receiving assistance be individually eligible for the household to qualify for assistance. The rule proposes requiring verification of citizenship or eligible immigration status of all participants in HUD housing programs, regardless of age and whether or not the individual contends that they are eligible. Under existing regulations, individuals who do not contend that they are eligible for assistance and individuals older than 62 are not required to provide proof of citizenship or eligible immigration status.

    Second, the proposed rule would amend regulations to allow mixed-status families to receive prorated housing assistance only pending verification of the eligibility status of all family members. Mixed-status households are homes in which a family member ineligible for public housing lives together with other eligible family members. Under existing regulations, residents of mixed-status households could receive housing assistance, prorated according to the number of eligible members in the household, for an indefinite period of time.

    Comments on the proposed rule are accepted until April 21, 2026.
