ICE delegates customs officer authority to ERO Executive Associate Director

    ICE Acting Director Lyons issued a delegation order vesting the Executive Associate Director (EAD) for Enforcement and Removal Operations (ERO) with "limited customs officer enforcement authority" in order to:

    • Execute and serve any order, warrant, subpoena, summons, or other process issued under the authority of the United States; and make an arrest without a warrant for any offense against the United States committed in the officer's presence or for a felony committed outside the officer's presence if the officer has reasonable grounds to believe that the person to be arrested has committed or is committing a felony; and
    • Aid in the enforcement of quarantine rules and regulations as authorized and directed by the Director of the Centers for Disease Control and Prevention of the Department of Health and Human Services.

    The order also notes that this authority "may be re-delegated in writing by the EAD for ERO to appropriate subordinate officials of ICE," and any officer above the level of Field Officer Director can then successively re-delegate "to other officers or employees of ICE qualified to exercise the authority within ERO."
