ICE issues guidelines for treatment of detainees with disabilities

    ICE issued a directive establishing guidelines for ICE Enforcement and Removal Operations (ERO) to communicate with detention facilities about the treatment of detainees with disabilities. The directive specifically addresses individuals in immigration detention facilities and family residential centers, and is intended to implement Section 504 of the Rehabilitation Act and relevant DHS regulations.

    The directive states that it is ERO policy that detainees with disabilities will be provided an equal opportunity to access, participate in, or benefit from in-custody programs, and that detainees with disabilities will be provided with auxiliary aids and services as necessary. Detainees may request appropriate auxiliary aids and services, reasonable accommodations, and policy modifications, but ICE and detention facilities are not required to provide the requested accommodations if they would create a fundamental alteration or an undue burden.

    This directive supersedes ICE Directive 11071.1, issued in 2016. The directives are substantially the same, but Directive 6000 redacts certain information collection systems used for evaluation under Section 5.1 and allows for consideration of “updated” procedures and guidelines in determining transfers under Section 5.4
