ICE releases policy memo on expanded use of HHS data

    ICE released Policy Memorandum 11066.2, "Use of HHS (Department of Health and Human Services) Information and Recession of ICE Policy Memorandum 11066.1," to update the agency's policies on accessing health-related federal data. In the PM, ICE reaffirms its authority to request, receive, and use HHS information "that may be useful for any and all law enforcement activities that ICE is authorized to pursue as a matter of federal law." This includes information provided to HHS Center for Medicare and Medicaid Services (CMS), such as information about immigration status. The PM states that ICE contemplates using HHS's biographical, contact, and location information, but reserves the right to consider other information on a case-by-case basis.

    The PM rescinds PM 11066.1, "Clarification of Existing Practices Related to Certain Health Care Information," issued in 2013, which stated that ICE would not use health coverage eligibility information "as the basis for pursuing a civil immigration enforcement action."
