Reported: IJs Allow ICE Attorneys Not to Identify Themselves in Immigration Court

    The Intercept reports that in at least two New York City-based immigration courts, immigration judges (IJs) declined to state the names of ICE attorneys arguing in deportation proceedings. The IJs, Judges ShaSha Xu and James McCarthy, both obscured the identities of the ICE attorneys. Judge Xu attributed the change in disclosure to “privacy” because “things lately have changed," while Judge McCarthy merely referred to the ICE attorneys as "Department." Another New York City IJ, Judge Shirley Lazare-Raphael, told The Intercept that the new phenomenon of occluding ICE attorneys’ names has not been formalized via a directive or rule.
