March 9, 2021Designation of Venezuela for Temporary Protected Status and Implementation of Employment Authorization for Venezuelans Covered by Deferred Enforced Departure
On March 9, 2021, DHS designated Venezuela for Temporary Protected Status (TPS) and additionally provided guidance for Venezuelans eligible for DED under the Trump-era announcement to apply for work authorization under DED.
This Biden administration action retains the Trump-era policy identified in this entry but separately offers similar protections to a larger class of Venezuelan nationals (and those without nationality who last habitually resided in Venezuela) under the TPS authority.
DHS notes that unless DED is extended, DED and employment authorization for those covered under the original Trump-era policy will expire on July 20, 2022.

July 11, 202207.11.22 - DHS Announces Extension of Temporary Protected Status for Venezuela
Secretary of Homeland Security Alejandro N. Mayorkas extended the designation of Venezuela for Temporary Protected Status (TPS) for 18 months, effective from September 10, 2022, through March 10, 2024. Only beneficiaries under Venezuela’s existing designation who were already residing in the United States as of March 8, 2021 will be eligible to renew registration for TPS under this extension.
Although this Biden action did not itself revoke the original Trump action pertaining to the grant of DED to Venezuelans, the decision by the Biden administration not to extend DED and to instead allow it to expire on July 20, 2022, meant that this extension of TPS through March 10, 2024, effectively replaced the Trump-era policy announced in the original entry.

On September 20, 2023, Secretary of Homeland Security Mayorkas announced the extension and redesignation of Venezuela for Temporary Protected Status (TPS) for 18 months, due to extraordinary and temporary conditions in Venezuela that prevent individuals from safely returning. This redesignation provides temporary protection from removal, as well as employment authorization for individuals in the United States before July 31, 2023, extending such protection to approximately 472,000 Venezuelans, in addition to the approximately 242,700 already covered by TPS.
