November 25, 2020ORR has submitted a new proposed data collection for OMB approval, the Serious Medical Procedure Request Form. The form, which will be completed by healthcare provider and ORR grantee staff, will provide data for ORR to determine whether to approve requests for children in ORR custody to receive surgery or other procedures treating complex medical or dental conditions. Procedures requiring general anesthesia, surgeries, and invasive diagnostic procedures (e.g., cardiac catheterization, invasive biopsy, amniocentesis) require advance ORR approval. The form will not be required for emergency procedures, procedures performed during hospitalization, or procedures resulting from complication of a previously approved procedure. Comments from the public are due within 30 days. [ID #1189]

On April 30, 2024, the Department of Health and Human Services, Administration of Children and Families, enacts a final rule regulating key aspects of the placement, care, and services provided to unaccompanied children in custody of the Office of Refugee Resettlement (ORR). The final rule implements the 1997 Flores Settlement Agreement.
Section 410.1307 of final rule addresses Healthcare Services and includes a provision stating that "ORR must not prevent unaccompanied children in ORR care from accessing healthcare services, including medical services requiring heightened ORR involvement [including significant surgical or medical procedures] and family planning services. ORR must make reasonable efforts to facilitate access to those services if requested by the unaccompanied child."
