    Section 10 of Presidential EO 14159, "Protecting the American People Against Invasion," directs the Secretary of Homeland Security to take all appropriate actions to ensure the detention of "aliens" apprehended for violations of immigration law pending the outcome of their removal proceedings or their removal from the country, to the extent permitted by law.

    ICE is reportedly releasing some migrant detainees, at times dozens per day, as the Trump Administration's enforcement policies have caused ICE facilities to reach 109% capacity across its network of for-profit prisons and county jails. The release of detainees appears a temporary solution to addressing overcrowding; ICE has stated that it will request additional funding from Congress to build 14 new detention sites that can hold up to 1,000 detainees each. ICE officials have further stated that they are working to execute removal orders more quickly to mitigate overcrowding.

    The Guardian estimates that "about 1,400 arrests, or about 8% of the nearly 16,500 arrests in the administration's first month — may have occurred during or right after people checked in with the agency." Laura Urias, a program director and attorney at ImmDef, notes that ICE's policy of arresting noncitizens at check-ins "hasn't been consistent . . . we haven't seen much of a pattern, per se."
