EO 14159 § 16 directs DOS, DHS, and DOJ to rescind policies from prior administration that “led to the increased or continued presence of illegal aliens in the US.”

    Section 16 of Executive Order (EO) 14159, "Protecting the American People Against Invasion," directs DOS, DHS, and DOJ to rescind policies of the prior administration "that led to the increased or continued presence of illegal aliens" and align "all departmental activities" with the EO and immigration laws. Such actions must include, but are not limited to:

    • Ensuring parole authority under 8 U.S.C. § 1182(d)(5) "is exercised on only a case-by-case basis" and "only when individual alien demonstrates urgent humanitarian reasons or significant public benefit."
    • Ensuring designations of Temporary Protected Status are consistent with 8 U.S.C. § 1254a, "appropriately limited in scope," and "made for only so long as may be necessary."
    • Ensuring employment authorization is provided in a manner consistent with 8 U.S.C. § 1324a.

      2025.01.22 Priorities and Mission of the Second Trump Administration’s Department of State

      Secretary of State Marco Rubio issued a press statement outlining DOS's migration priorities during the Trump administration. The statement says that "[t]he State Department will no longer undertake any activities that facilitate or encourage mass migration. Our diplomatic relations with other countries, particularly in the Western Hemisphere, will prioritize securing America’s borders, stopping illegal and destabilizing migration, and negotiating the repatriation of illegal immigrants."
