    Executive Order (EO) 14148, "Initial Rescissions Of Harmful Executive Orders And Actions," rescinds Executive Order 13986 titled "Ensuring a Lawful and Accurate Enumeration and Apportionment Pursuant to the Decennial Census." The rescinded order was issued by President Biden on January 20, 2021, and required decennial census counts to include all residents regardless of immigration status.

    The state of Missouri and four individual Missouri voters filed a lawsuit against the U.S. Department of Commerce, Secretary of Commerce, U.S. Census Bureau, and Acting Director of the U.S. Census Bureau, challenging the inclusion of undocumented immigrants and temporary-visa holders in the census count used for congressional apportionment. Plaintiffs allege that including these categories of people violates the Census Clause, Electoral College Apportionment Clause, and APA. Plaintiffs seek declaratory and injunctive relief requiring defendants to redo the 2020 Census and Apportionment and prohibiting them from including undocumented immigrants and temporary-visa holders in the 2030 Census and 2031 Apportionment.
