April 15, 2025President Trump issued a memorandum, “Preventing Illegal Aliens From Obtaining Social Security Act Benefits,” to provide additional direction for implementing Executive Order 14218 with regard to Social Security Act (SSA) programs. Among other things, the memorandum:
- Directs the DOL Secretary, HHS Secretary, and Commissioner of Social Security to take all reasonable measures to ensure that ineligible noncitizens are not receiving funds from SSA programs, including by promulgating guidance and prioritizing enforcement actions against grantees or sub-grantees that do not take adequate measures to verify eligibility, stop payments to deceased or ineligible payees, or otherwise prevent ineligible noncitizens from receiving funds from SSA programs;
- Directs the Attorney General (AG) and the Commissioner to expand SSA's full-time fraud prosecutor program and directs the AG and HHS Secretary to establish a similar fraud-prosecutor program for Medicare and Medicaid; and
- Directs the Commissioner to review whether SSA should pursue civil monetary penalties.

2025.05.12 DHS: Department of Homeland Security Investigates State of California for Providing Federal Benefits to Illegal Aliens
ICE's Homeland Security Investigations (HSI) Los Angeles Field Office issues a Title 8 subpoena to the State of California’s Cash Assistance Program for Immigrants (CAPI). CAPI provides benefits to noncitizens who are ineligible for federal Social Security benefits due to their immigration status.
The subpoena requests all records between January 2021 to present from the Los Angeles County Department of Public Social Services, the agency that administers the benefits, to determine if ineligible noncitizens received Social Security benefits. The records subpoenaed include demographic information such as name, date of birth, and immigration status, as well as copies of applications submitted.
