Reported: ICE detaining Cubans released on recognizance during their check-ins

    The Miami Herald reports that ICE has detained Cubans with I-220A "Order of Release on Recognizance" documents during immigration check-ins in Miami. The I-220A is given to some migrants who were detained and then released after processing at the border. ICE has reportedly issued the document to hundreds of thousands of Cubans.

    Though the Board of Immigration Appeals ruled in 2023 that Cubans released with an I-220A do not qualify for permanent residency through the Cuban Adjustment Act, they can apply for asylum or lawful permanent residency through family sponsorship.

    Immigration lawyers say that detention of Cubans with I-220As is a new development due to the Trump administration's ramped-up enforcement priorities.
