March 21, 2025According to Law360, attorneys from the NYCLU and The Bronx Defenders filed a motion alleging that ICE breached a 2022 settlement agreement requiring ICE to make individualized custody decisions rather than applying a blanket “no release” policy. The original lawsuit was filed in 2020, after ICE was revealed to use a biased risk-assessment tool for widespread detention without proper review.
The attorneys submitted that ICE’s New York Field Office is once again detaining almost all noncitizens, releasing just one person and offering bond to none between January 2024 and February 2025. This is a 99.8% detention rate.
