Reported: Border Patrol may check immigration status of students traveling on schoolbuses through CBP checkpoints

    As reported by the Texas Tribune, U.S. Customs and Border Protection (CBP) said in an emailed statement that "if a bus travels through an immigration checkpoint, immigration officers may verify the immigration status of its passengers, including students."

    This statement was made after the Alice Independent School District in South Texas warned parents that Border Patrol agents may check the immigration status of students on school buses traveling for extracurricular activities. CBP stated that while it is not targeting school buses, buses may be stopped when at checkpoints and passengers' immigration status verified.

      Border Patrol agents boarded an unmarked charter bus carrying ten student-athletes and a swim coach to a meet in Albuquerque at the CBP checkpoint outside of Las Cruces, New Mexico, on Interstate 25. The swim coach told journalists that the agent who boarded the bus asked the driver in English how many people were on the bus; when the driver failed to respond in English, the coach states that the agent "started yelling Spanish, demanding documentation from all the passengers." CBP defended the search as a "routine immigration inspection."

      U.S. Representative Gabe Vasquez (D-NM) sent a letter to DHS Secretary Noem raising "serious concerns about reports federal agents harassed students in my community" on the bus in Las Cruces. Rep. Vasquez stated that such incidents, "along with reports of harassment of Tribal members and other American citizens based on profiling, are unacceptable," and demanded that Secretary Noem provide his office with "a full accounting and explanation of this incident, a written policy for how agents are to address minors, and any steps your agency will take to prevent such events from occurring in the future."
