Reported: Military attorneys to be temporarily reassigned to DOJ for immigration enforcement

  1. Original Date Announced

    October 27, 2025

The Associated Press (AP) reports that Defense Secretary Pete Hegseth has ordered the armed forces to identify 48 military attorneys and four paralegals for temporary reassignment to DOJ to work as special assistant U.S. attorneys (SAUSAs) in offices along the U.S.-Mexico border. The memo states that DOJ has also requested 20 attorneys to help support its offices in Memphis, where the administration deployed National Guard troops; 12 attorneys for El Paso, Del Rio, and Midland, Texas; and three attorneys and two paralegals for Las Cruces, New Mexico. The reassignments may last through fall 2026. The memo does not describe work that the reassigned attorneys will perform, but states that attorneys should ideally have “significant experience” in immigration and administrative law.

The request follows a September 26, 2025, ask from DOJ for 35 attorneys and two paralegals from DOD, according to the memo. It is unclear whether that figure was in addition to the 48 attorneys now requested.
