USCIS issues guidance to revoke DACA for attempted purchase of a firearm

    USCIS policy memorandum (PM-602-0191) directs USCIS officers to treat an unlawful attempt by a DACA recipient to purchase a firearm as a serious negative discretionary factor that may warrant termination of DACA protection. Generally, when USCIS becomes aware that a DACA recipient attempted to unlawfully purchase a firearm, USCIS will issue a Notice of Intent to Terminate (NOIT); the DACA recipient then has an opportunity to respond and provide evidence to overcome the termination. The guidance provides that USCIS may terminate someone's DACA without a NOIT if the DACA recipient is convicted of certain national security-related offenses or public-safety offenses. USCIS officers are instructed to evaluate the totality of the circumstances, including reliance interests and any public safety concerns.
