Small Business Administration proposes requiring loan applicants to disclose immigration status

    The Small Business Administration (SBA) proposed revisions to SBA Form 1919, Borrow Information Form, which small businesses may use to apply for a government loan under § 7(a) of the Small Business Act (15 U.S.C. § 636(a)(1)(B)). The proposed changes are made in response to recent EOs and Trump administration priorities, including EO 14159, "Protecting the American People Against Invasion."

    The SBA proposes revising the "Applicant Ownership (Mandatory) and Demographic Information" section of Form 1919, requiring disclosure of the applicant's and any beneficial owners' citizenship status and the alien registration numbers (ARNs) of applicants or beneficiaries who are lawful permanent residents (LPRs).

    SBA also proposes adding a certification that "100% of the Beneficial Ownership in the Applicant and Operating Company is held by citizens of the United States, U.S. Nationals, or individuals who are Lawful Permanent Residents (LPRs)."

    Public comments on the proposed revisions are due by May 30, 2025.
