Immigration Services and Legal Advocacy filed a lawsuit in the Eastern District of Louisiana challenging Louisiana Act 399, which makes it a crime punishable by monetary fines and imprisonment to “[knowingly] commit any act intended to hinder, delay, prevent, or otherwise interfere with or thwart federal immigration enforcement efforts,” and Attorney General Liz Murrill's threats to prosecute such offenses. The Complaint alleges the Act violates the First and Fourteenth Amendments as applied to the plaintiffs by criminalizing protected speech and by being unconstitutionally vague, including Know Your Rights training presentations the organization conducts explaining immigrants’ legal protections during ICE arrests. Plaintiffs specifically argue that Act 399 will chill their free speech, including their ability to speak out and advise the community about activities taking place during Operation Swamp Sweep.
