November 17, 2025DHS published an agreement between the U.S. and Ecuador under which third-country nationals who seek asylum or other humanitarian protection in the U.S. may be removed to Ecuador to seek protection there. Under the agreement, the U.S. maintains discretion to propose transfers to Ecuador, and Ecuador retains discretion to accept or deny. Ecuador agrees not to return transferred migrants to their home country or country of former residence until it has made a final determination regarding claims for humanitarian protection. The U.S. agrees not to transfer unaccompanied children to Ecuador. The agreement does not restrict removal to migrants of certain nationalities or migrants who passed through Ecuador.
The agreement between the countries was signed in July 2025. The Federal Register notice does not include an evaluation of whether Ecuador is safe for migrants seeking humanitarian protection.
