February 24, 2025USCIS announced that Form I-914, “Application for T Nonimmigrant Status,” had been updated and the January 20, 2025 edition would be effective as of February 24, 2025.
The updates to Form I-914 include:
- Request the applicant's biological sex at birth, and will only allow responses of "M" or "F," not "X"; and
- Replaces the term "gender" with "sex."
In the supporting statement that USCIS submitted to the Office of Management and Budget alongside the updated form, the agency stated that this change was necessary to comply with Section 2 and 3 of EO 14168, "Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government." USCIS characterized the change as a “non-substantive change to a currently approved collection request” for which "[p]ublication of Federal Register Notices is not required."

- January 20, 2025 EO 14168 § 3(d) directs DOS and DHS to require that government-issued identification documents reflect "immutable biological" sex
- February 14, 2025 DOS proposes changes to Form DS-11 (Application for a U.S. Passport), and will no longer issue passports with "X" sex markers
- February 18, 2025 DOS proposes changes to Form DS-5504 (Application for a U.S. Passport for Eligible Individuals: Correction, Name Change to Passport) to no longer allow "X" gender marker
- February 18, 2025 DOS proposes changes to DS-82 (U.S. Passport Renewal Application) to eliminate "X" gender marker from application
