USCIS clarifies requirements for Special Immigrant Juvenile Classification

    USCIS issues three Administrative Appeals Office (AAO) adopted decisions (Matter of E-A-L-O-, Matter of A-O-C- ; and Matter of D-Y-S-C-) to clarify: 1) juvenile/state court evidentiary requirements regarding dependency, including that the petitioner met the definition of a juvenile when the order was issued and the court determined the juvenile was subject to parental abuse, neglect, abandonment; and 2) that USCIS will no longer require evidence that a state court had the authority to place a petitioner in the custody of an unfit parent in order to make a determination regarding parental reunification.
